Terms of Purchase

This agreement regulates the general conditions of purchase of the various products and services offered on this website by XAVIER PAREDES ANALYTICS, S.L. (hereinafter XAVIER PAREDES ANALYTICS) with Tax ID No. B16995318 and registered address at Calle Cardenal Reig, 31, ESC. A, 7-1 (08028) Barcelona (SPAIN).

The CUSTOMER, at the moment of completing the registration process and purchasing any of our products, expressly accepts and submits to the clauses specified below, as well as to the conditions of access and use of our portal and its privacy policy, accessible through the link Privacy Policy.

The CUSTOMER acknowledges having sufficient legal capacity to enter into contractual obligations.

This contract is permanently accessible in the legal notices of our website.

1. PRICES AND TAXES

In consideration for the product acquired, the CUSTOMER expressly agrees to pay XAVIER PAREDES ANALYTICS the amounts specified at the time of purchase according to the price list established on the website https://app2.ultraeco8k.com/ for the chosen products.

The products offered on this website are subject to Value Added Tax (VAT) which IS INCLUDED in the prices detailed for each product.

Before proceeding with payment for the product, the final purchase price including VAT (Value Added Tax) will appear on screen and will be reflected in the order form at the time of purchase and on the invoice.

Anything not specifically mentioned in the description as included is not included.

2. PURCHASE PROCEDURE

Orders may only be placed by individuals over 18 years of age and companies. There are two purchase methods: through the website and through a payment link.

2.1 Through the website

The CUSTOMER can acquire credits that will allow them to download digital products. The process to acquire credits is as follows:

  1. If it is the first time you access our portal, you must complete a registration form with your personal data and create a personal account as a user. After completing this step, you will receive confirmation that the registration has been completed correctly at the email address you provided. If you are an already registered user, to continue with the purchase process, you only need to enter the username and password you created during your first purchase. The username and password are personal and belong to the person who completed the registration process, who is solely responsible for their safekeeping.
  2. Upload an ultrasound and provide the necessary information to generate a sample of the digital product.
  3. Preview and validate the low-resolution result with a watermark.
  4. Open the Credits menu and select the number of credits you wish to purchase.
  5. Next, the order will be verified, detailing each selected item one by one and calculating the total price.
  6. It will also be necessary to provide an address for billing purposes for the purchase made.
  7. Once the process has been completed, you must check a verification box to confirm that you have read and accepted the terms and conditions of sale.
  8. The website will provide you with mechanisms to make the payment according to the system chosen in each case.
  9. Once the payment details have been entered, you must confirm the order by clicking the "Buy" button.
  10. After clicking the "Buy" button, the acquired credits will be added to your account and you can proceed to "Unlock" and "Download" the product.

The CUSTOMER is informed that the images shown in the preview may differ, not substantially, from the delivered product, as colors or shapes may be perceived differently by each consumer due to multiple variables, such as the devices on which the products are viewed or environmental conditions such as light. However, these or other variables will never alter the characteristics of the products, which will be those described on the website and, in any case, the CUSTOMER may choose to withdraw from the purchase as indicated in these conditions.

2.2 Through a payment link

If the purchase is made through a payment link, the steps to follow are:

  1. The CUSTOMER receives in their email a preview with a watermark and low resolution of the digital product they wish to purchase.
  2. After validating the preview, if the customer is satisfied with the product and wishes to proceed with the purchase of the digital product without a watermark and in higher resolution, they must click on the payment link provided.
  3. Once the payment link is clicked, the order will be processed and you can proceed to download or receive the product following the instructions that will appear.
  4. Next, the order will be verified, detailing each selected item one by one and calculating the total price.
  5. It will also be necessary to provide an address for billing purposes for the purchase made.
  6. Once the process has been completed, you must check a verification box to confirm that you have read and accepted the terms and conditions of sale.
  7. The website will provide you with mechanisms to make the payment according to the system chosen in each case.

  9. After clicking the "Buy" button, the product will be sent to the email address provided by the CUSTOMER.

3. AVAILABILITY AND DELIVERY

The products offered by XAVIER PAREDES ANALYTICS are available for purchase anywhere in the world.

Orders will be processed once payment has been correctly received and will be received automatically following the purchase instructions (download/email delivery).

To ensure you are informed about the status of your purchase at all times, you will receive an email notification confirming your order and payment.

Additionally, the CUSTOMER can check the status of their order or make any request if they have not received or been able to download the product by sending an email to hello@realbabyultrasound.com.

4. PAYMENT AND PAYMENT PERIODS

The following payment methods are accepted:

  • Credit and Debit Card: The transaction is carried out by connecting directly with Stripe through its payment gateway.
  • Bank transfer: making a deposit of the total amount of the purchase into the indicated current account.
  • Other alternative payment methods such as iDEAL, Bancontact, EPS, and Klarna.

Once payment has been made, you will receive a confirmation email.

XAVIER PAREDES ANALYTICS has no knowledge of your credit card details and will only retain the CUSTOMER's banking details for the purpose of direct debit payment. All our payment systems are completely secure.

Payments are made prior to the delivery of the product or provision of the service, so XAVIER PAREDES ANALYTICS will not provide the requested product until payment has been received. XAVIER PAREDES ANALYTICS reserves the right to temporarily or permanently cancel the services provided in the event of any payment-related incident.

5. INVOICES

Upon making the corresponding payment, you will receive the Invoice for your purchase in PDF format via email if you have expressly indicated this when processing the order.

The CUSTOMER is responsible for confirming receipt of notifications and informing us of any changes to their data, with XAVIER PAREDES ANALYTICS being exempt from any liability arising from this circumstance.

6. WARRANTY

All our products are subject to quality controls and are guaranteed against production defects for a period of 2 years, as they are digital content, from the date of delivery or receipt of the product. The warranty covers any defect that prevents access to or enjoyment of the purchased digital content. The warranty only covers defective products. During the warranty period, the CUSTOMER may request repair, replacement, price reduction, or contract termination as appropriate, which will be free of charge for the CUSTOMER.

The warranty document is the purchase invoice.

7. RETURNS

Given the nature of the service that is the subject of this contract, returns are not possible. Even so, if the CUSTOMER is not satisfied with the product received, they can contact customer service at hello@realbabyultrasound.com so that we can review their request.

8. RIGHT OF WITHDRAWAL

Given the nature of the product:

  • Products made according to consumer specifications (all our products are generated based on information previously provided by the consumer).
  • Products with automatic reception/access and of a digital nature (all our products are generated automatically from payment and their delivery is an automatic digital download, considered digital content).
  • The CUSTOMER can also see a preview of the digital product they are going to purchase.

According to Article 103 points "c" and "m" of Royal Legislative Decree 1/2007, of November 16, on Consumer and User Protection, the right of withdrawal is not applicable to this contract.

9. PERFECTION OF THE CONTRACT AND MODIFICATIONS OF SERVICES

This contract will be perfected with the payment for the product.

XAVIER PAREDES ANALYTICS reserves the right to modify in any way the characteristics and conditions of its services, always with the aim of improving them and providing a benefit to the CUSTOMER.

10. OBLIGATIONS OF THE PARTIES

XAVIER PAREDES ANALYTICS undertakes to provide the CUSTOMER with the products and services that have been contracted, applying the utmost diligence in the provision of the service, as well as to take care of the maintenance of the facilities necessary for the operation of the network, having an adequate technical and IT team for this purpose, and to manage the logistics, shipping, and delivery operations of the purchase made through the carrier.

The CUSTOMER undertakes to use the services made available to them in good faith, without violating current laws in any matter or infringing the rights of third parties, as well as to pay for the selected product at the time and in the manner established in these sales conditions and to receive it at the place indicated for delivery.

XAVIER PAREDES ANALYTICS does not guarantee that the availability of the service subject to this contract will be continuous and uninterrupted, due to circumstances caused by problems in the Internet network, faults in computer devices, and other unforeseeable circumstances. Therefore, the CUSTOMER agrees to bear these circumstances within reasonable limits.

The CUSTOMER is aware that the results provided by the Service are fictional and should not be used for medical or diagnostic purposes. And that, furthermore, the results provided by the Service are automatically generated and may contain offensive, inappropriate, or objectionable content by error, as sometimes the results provided by the Service may produce unreal or unexpected results, in which case we ask that it be brought to our attention for review.

11. COMMUNICATIONS

All notifications between the parties will preferably be made via email. The CUSTOMER is responsible for confirming receipt of notifications and informing XAVIER PAREDES ANALYTICS of any changes to their data, with the latter being exempt from any liability arising from this circumstance. In case of modification, the CUSTOMER must inform XAVIER PAREDES ANALYTICS via the email or telephone numbers indicated on our website.

In compliance with Article 21 of Law 34/2002 on Information Society Services and Electronic Commerce, we inform you that our commercial mailings and information relating to our website and the products offered on it will be sent by email to the email address you provide us, always with a revocable nature. In any case, you have the option to reject our commercial communications by sending an email to hello@realbabyultrasound.com indicating the word UNSUBSCRIBE in the subject line.

12. COMMITMENT, ACCEPTANCE, AND VALIDITY OF THE CONTRACT

The CUSTOMER acknowledges having read and accepted the legal conditions of use and the privacy policy of the website.

The CUSTOMER acknowledges that they have understood all the information regarding the products and services, including, where applicable, delivery, offered on our website, as well as all the conditions and stipulations contained in this electronic contract, and therefore affirms that they are sufficient to exclude error in the consent of this contract, and therefore, accepts them fully and expressly.

The CUSTOMER is fully aware that the acceptance and execution of this contract will take place through the provision of their data and clicking the "Buy" button indicated on our website and that it will be perfected with the payment for the service.

13. APPLICABLE REGULATIONS

This contract is commercial in nature and will be governed and interpreted in accordance with Spanish laws.

In the event of any type of discrepancy or difference between the parties in relation to the interpretation, content, or execution of the Contract that is not resolved by mutual agreement, the Parties will submit to the courts or tribunals that are competent in each case, provided that the user is a consumer (their domicile).

In cases where it is foreseen that the parties may submit to a jurisdiction, they will submit to the Courts and Tribunals of the city of Barcelona (Spain), expressly waiving any other that might correspond to them.
